1.- PERSON ORGANIZING THE PROMOTIONS

2.- START DATE AND END DATE
The Promotion bases will apply to all draws between January 1, 2022 and December 31, 2022 at 11:59 p.m.
3.- REQUIREMENTS FOR PARTICIPATION AND MECHANICS OF THE PROMOTIONS
The participation requirements will be the following:
Those who reside in Spanish territory, are of legal age and who have an active Instagram account during the participation period may participate.
4.- CONDITIONS OF PROMOTIONS AND PRIZES
The draw among the participants will take place on the date indicated in each case in the Facebook/Instagram post and the winner will be notified in the same post in which the draw is made. In this way, the winner will contact ESCARAPELA via private message.
The result of the prize will be made through EasyPromosApp or Sortea2, a third-party application that performs random draws, offering a certificate of validity.
If the initial winner does not claim the prize, ESCARAPELA reserves the right not to deliver said prize.
In the event of being the winner or alternate, the participant authorizes the publication of their personal identification data in the channels indicated in this same point and the following, with the sole purpose of carrying out the publication of the winners and reservations.
The prize may not be identical to the one advertised, but its similarity in price and characteristics will be guaranteed.
Prizes are non-transferable and cannot be exchanged for money. Limited to one prize per person. ESCARAPELA reserves the right to substitute the prize for another analogous one of the same or higher value in case of force majeure. In no case may prizes be exchanged for their cash value.
5.- COMMUNICATION
ESCARAPELA reserves the right to communicate the name of the winner of the draw in different advertising media and on its website. Only for the fact of accepting the prize, the beneficiary authorizes ESCARAPELA to use his image in the advertising exploitation that is made of the awarded prize. The acceptance of the prize implies the acceptance of this clause.
6.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the participants does not meet the requirements of the Bases, or the data provided to participate are not valid, their participation will be considered null and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.
Profiles dedicated to participating in sweepstakes, or other indications of being ghost profiles, will be excluded from the prize. We understand ghost profiles by profiles that meet some of these requirements:
Profiles that do not have a profile picture
Profiles that have no more than 15 followers
Profiles that have no more than 5 posts
Profiles that, despite meeting the above parameters, do not have reactions on their posts
7.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions in which the content is considered inappropriate, that are offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Nor will comments against an individual that violate the principles of the right to honor, personal and family privacy and one's own image be allowed. We will not be responsible for the damages caused by the comments made by the participants in the Promotions, and that at any time could offend the sensitivity of other participants.
8.- EXONERATION OF LIABILITY
The winner is responsible for collecting any permission or consent necessary to enjoy the prize and any incident that occurs during it.
The prizes are subject to these legal bases and it will not be possible to substitute them totally or partially for cash. The prizes will not be subject to change, alteration or compensation at the request of the winners. If the prize is rejected by the winner, no alternative will be offered. Its sale or alienation is strictly prohibited.
The participants of the raffle exonerate, in the broadest way that the law proceeds and without limiting their rights as consumers, the organizer, from any type of liability, sanction, claim, demand or civil, commercial, criminal, administrative cause, including compensation of any nature and/or nature, expenses, costs (with the express inclusion of lawyers' and solicitors' fees).
The participant accepts that the organizer may postpone, shorten, extend, modify, cancel or suspend the draw as a result of force majeure causes beyond their control, undertaking to inform the participants of this circumstance as soon as possible.
The organizer is empowered to resolve any contingency not provided for in these legal bases.
9.- CHANGES
We reserve the right to modify or expand these promotional bases, to the extent that it does not harm or impair the rights of the participants in the promotions.
The simple fact of participating in a draw implies full acceptance of these Bases. If the prize is not accepted as stated in these Bases, it would be understood that it is waived.
10. -Applicable legislation and jurisdiction
These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the city of Valencia will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these bases.
11.- FINAL CONSIDERATIONS
This raffle is free for the participants. Both the draw and the prizes are subject to change or modification.
